These Terms of Use govern your access to and use of the Athera platform. By accessing or using Athera, you agree to be bound by these terms. If you do not agree, do not use the platform.
1. Platform Description
Athera is a multi-channel AI operations platform that provides a unified inbox, AI agents, task management, and workflow automation for businesses. Athera is a software provider and does not act as the sender of messages. We are not responsible for the content sent by our clients through the platform.
2. Messaging Responsibility
By using Athera, you agree that:
- You have obtained proper permission and consent to message end users through all connected channels
- You comply with all applicable laws and regulations, including WhatsApp Business Policy, Twilio Acceptable Use Policy, Meta Platform Terms, and local telecommunications laws
- You are solely responsible for the content sent via Athera, including messages generated by AI agents that you have configured and activated
3. Platform Role
Athera operates as:
- A software-as-a-service provider offering unified messaging and operations tools
- A data processor (not a data controller) when processing end customer messages on your behalf
- A technology provider that is not responsible for the content of messages, the accuracy of AI responses, or business decisions made based on platform outputs
4. AI Disclaimer
- AI-generated responses may contain errors, inaccuracies, or incomplete information
- Clients must review and supervise AI agent outputs, especially for critical business operations
- Athera is not responsible for decisions made by AI agents or for any consequences arising from automated actions
5. Prohibited Uses
You may not use Athera to:
- Send spam, unsolicited messages, or bulk marketing without proper consent
- Distribute illegal, harmful, threatening, abusive, or harassing content
- Scrape, harvest, or collect data from the platform beyond your authorized use
- Attempt to reverse engineer, decompile, or access Athera's source code or proprietary algorithms
6. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the platform. We may perform scheduled maintenance and reserve the right to modify or discontinue features with reasonable notice.
8. Limitation of Liability
To the maximum extent permitted by law, Athera shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the platform, including but not limited to lost revenue, data loss, or business interruption.
9. Governing Law
These terms shall be governed by the laws of the European Union, including the GDPR, and the applicable laws of the jurisdiction in which Athera operates. Any disputes shall be resolved in accordance with applicable EU regulations.
